Terms and Conditions for Gift Cards and Promotional Gift Certificates
The present General Terms and Conditions (the “Agreement”) govern the purchase, use, and management of gift cards and gift certificates (collectively referred to as the “Cards”) issued by Gouverneur Inc. (“Gouverneur”). By purchasing, accepting, or using a Card, you agree to be bound by these terms. If you do not agree to these terms, you should not purchase or use the Card.
1.About Your Card
Cards are issued by Gouverneur Inc. and its business partners: OTL Gouverneur, Boefish, and PAŪS Spa Experience. Gouverneur Inc. is the sole legal debtor concerning the use of the Cards. Gift cards can be purchased at participating businesses, while promotional gift certificates are distributed as part of loyalty, reward, or promotional programs. Goods purchased with a Card are subject to the merchant’s return policy.
2. Balance Information and Inquiries
You can check your gift card balance online; however, please note that the balance displayed is an estimate. Balances are generally updated immediately after a purchase, but delays may occur. The balance of promotional gift certificates cannot be verified online.
3. Using Your Card
You may use up to five gift cards or gift certificates per transaction.
If the purchase amount exceeds the Card balance, you must pay the difference using another payment method.
If your purchase is less than the Card balance, the remaining balance can be used for a future purchase. However, for promotional gift certificates, any residual balance after a purchase is void.
Items purchased with a gift card and subsequently returned are subject to the merchant’s return policy. If a refund is applicable, it will be issued as a credit to a gift card unless otherwise required by law.
4. Purchase Limits and Restrictions
You may purchase up to five $1,000 CAD gift cards in a single transaction, with a total amount not exceeding $1,000 CAD. For larger purchases, please contact us directly.
Gift cards cannot be used to purchase other cards or be redeemed for cash, except as required by law.
5. Expiration of Cards
Gift cards do not have an expiration date, in compliance with applicable legislation. However, promotional gift certificates may have expiration dates depending on the specific promotion. You must refer to the specific terms of each promotional gift certificate to determine its expiration date.
6. Fees
No service, inactivity, or other fees will be applied to your Card unless required by law.
7. Redemption and Usage
Cards may only be used to purchase goods and services at participating businesses in Canada. They have no cash value and cannot be redeemed for cash unless required by law. Additionally, they cannot be used to purchase other Cards.
8. No Refunds
Cards are not refundable for cash, except as required by law. If you are dissatisfied with a purchase made using a Card, you must refer to the merchant’s return policy.
9. Lost, Stolen, or Damaged Cards
In the event of a lost, stolen, or damaged Card, it is important to report it immediately. However, the Card’s value will not be replaced. Gouverneur Inc. assumes no liability for lost or stolen Cards.
10. Limitation of Liability
Gouverneur Inc. and its business partners disclaim all liability, express or implied, concerning the Cards, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose. In case of a defective Card, your sole remedy is its replacement.
Some jurisdictions do not allow the exclusion or limitation of certain warranties, and some remedies may vary according to applicable local laws.
11. Changes to the Agreement
Gouverneur Inc. reserves the right to modify these terms and conditions at any time at its sole discretion. Any changes will be communicated through reasonable means, including, but not limited to, posting the revised version on our website. Significant changes will be communicated via email or by updating the policy on this page.
12. Fraud Prevention
Gouverneur Inc. reserves the right to decline to honor any Card suspected of being obtained fraudulently. If you believe a Card has been used fraudulently, you must contact our customer service team immediately.
